These Terms & Conditions ("Terms") govern your use of the Iniziova Play website and games, including Lumen Swarm (together, the "Services"), provided by Iniziova Software Solutions Pvt. Ltd. ("we", "us", "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be old enough to agree to these Terms in your country, or have permission from a parent or legal guardian who agrees to them on your behalf.

2. Licence to play

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Services for your own non-commercial entertainment. You may not copy, modify, distribute, sell, reverse engineer or create derivative works from the Services except as permitted by law.

3. Acceptable use

You agree not to:

• Cheat, exploit bugs, or use bots, hacks or unauthorised third-party software.
• Interfere with or disrupt the Services, servers or networks.
• Harass, abuse or harm other players.
• Use the Services for any unlawful purpose.

4. Purchases and virtual items

Some games may offer optional in-game purchases or virtual items. Virtual items have no real-world monetary value, cannot be exchanged for cash, and are licensed (not sold) to you. Purchases made through third-party platforms are also subject to that platform's terms and refund policies.

5. Intellectual property

All content in the Services — including games, artwork, music, code, logos and trademarks — is owned by Iniziova Software Solutions Pvt. Ltd. or its licensors and is protected by intellectual property laws. These Terms do not transfer any ownership to you.

6. Content you share

If you send us feedback, ideas or other content, you grant us a free, worldwide licence to use it to operate and improve the Services, without any obligation to you.

7. Third-party platforms and links

The Services may be distributed through, or link to, third-party websites and platforms. We are not responsible for their content, policies or practices.

We may update, change, suspend or discontinue any part of the Services at any time. We may also suspend or terminate your access if you breach these Terms.

9. Disclaimer

The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not guarantee that the Services will be uninterrupted, error-free or free of harmful components.

10. Limitation of liability

To the fullest extent permitted by law, Iniziova Software Solutions Pvt. Ltd. will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of the Services. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Privacy

Your use of the Services is also governed by our Privacy Policy.

12. Governing law

These Terms are governed by the laws of Nepal, without regard to conflict-of-law rules. Mandatory consumer protection laws of your country of residence still apply.

13. Changes to these Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continuing to use the Services after changes means you accept the revised Terms.
